This Website is maintained by Property, Developments and Investments Pty Limited trading as JC Property Agents ABN: 95 611 939 872 (referred to as “JC Property Agents”). In these Terms of Use (Terms) and any reference to JC Property Agents is taken to include a reference to the directors, officers, employees, agents and subsidiaries and related entities of JC Property Agents.
1. Acknowledgement and Acceptance
1.1 By using the JC Property Agents websites (Websites) and/or attending or viewing the JC Property Agents events (Events) you acknowledge that you have read, understood and accept the legal provisions in these Terms and Conditions. Websites mean any website owned and/or operated by JC Property Agents and any blogs, posts, articles, write-ups, vlogs, webinars, digital files, downloads, eBooks, podcasts and social media sites, including but not limited to those on Instagram, Facebook, YouTube, Twitter, LinkedIn, Snapchat, Pinterest or TikTok. Events mean any event, seminar, workshop, meeting, conference, activity, appointment, occasion or boot camp owned and/or operated by JC Property Agents.
1.2 JC Property Agents reserve the right to change, modify, add, alter, and delete the Websites and Events Terms at any time without notice and such modifications will take effect immediately.
2. Use of the Websites
2.1 The information contained on the Websites is subject to change without notice. Please check these Terms regularly. JC Property Agents also reserves the right to remove, modify and review any or all content from the Websites at its sole discretion.
2.2 JC Property Agents and its suppliers may make improvements or changes in the information, services, products, and other materials displayed on the Websites, or terminate the Websites, at any time without notice.
3. Your obligations when using the Websites
3.1 You are solely responsible and legally liable for your activity, use of and conduct on the Websites and any content that you create, transmit or display on the Websites and for the consequences of your actions (including any loss or damage that JC Property Agents or any third party could suffer) by doing so.
3.2 As a condition of your use of the Websites or any services on the Websites, you warrant to JC Property Agents that you will not use the Websites for any purpose that is unlawful or prohibited by these Terms. In particular, but without limitation, you agree not to:
– publish, distribute, email, transmit or disseminate any material which is unlawful, obscene, defamatory, indecent, offensive or inappropriate;
– use the Websites to defame, abuse, harass, store, threaten or otherwise offend others;
– impersonate any person or entity;
– engage in or promote any unsolicited emailing or spamming via the Websites;

– in any way make available using the Websites any material that you do not have a right to make available or which contains viruses or other computer codes, files or programmes designed to interrupt, limit or destroy the functionality of other computer software or hardware.
4. Copyright
4.1 All material available or accessible from the Websites is copyright material owned by JC Property Agents, its related entities, commercial partners or clients. Apart from fair dealing permitted by the Copyright Act 1968, visitors to the site are granted permission to download and display any of the website material for private and non commercial purposes. Prior consent in writing must be sought from JC Property Agents for any other use.

6. Events
6.1 JC Property Agents may refuse registration or entry to any individual. Events are not suitable for individuals under 18 years of age and entry may be refused.
6.2 Recording devices of any kind, animals and illegal substances are strictly prohibited. No part of the Events may be recorded, have photographs taken or reproduced without the prior written permission of JC Property Agents. No marketing or advertising material of any kind may be distributed at the Events.
6.3 Attendees of the Events should note that sessions may be recorded and may be published in various media, including print, audio and video formats without further notice. By attending any of the Events you irrevocably authorise and grant JC Property Agents the right to:
– record you (picture and voice) on photographs, film and/or video tape, for audio and visual production. (the Recording)
– edit the Recording into a photo gallery / short film / webinar (which may include other recordings and material);
– use your name and likeness, voice or other information concerning you; and
– screen or place online (including on social media) the Recording.
You hereby release JC Property Agents from any infringement or violation of personal and/or property rights of any sort whatsoever based upon the use of the Recording.
You acknowledge that JC Property Agents owns and shall own all rights, title and interest (including copyright) in the Recording.
You further acknowledge that JC Property Agents are not obliged to use the Recording.
You warrant that you have full power to enter into this Release and that the terms of this Release do not in any way conflict with any existing commitment on your part.
You understand that you will receive no monies for the Recording.
While under no obligation to do so, JC Property Agents will consider any reasonable request not to use or to stop using a particular Recording. Such requests should be made in writing here.
Should you not wish to grant JC Property Agents these rights, please contact JC Property Agents by email at least two weeks prior to any Events.
7. Disclaimers
7.1 JC Property Agents is not liable to you or any third party for any loss in connection with the use of the Websites or any other linked website (which may belong to any of JC Property Agents authorised agents or approved partners). This general disclaimer is not restricted or modified by any of the following specific warnings and disclaimers.
7.2 All information (including but not limited to the property area, floor size, price, address and general property description) on the Websites is provided as a convenience to you, and has been provided to JC Property Agents by third parties. JC Property Agents has no belief one way or the other as to whether the information contained on the Websites is correct, neither JC Property Agents nor its licensors or suppliers (nor their respective directors, affiliates or employees) have checked the accuracy of the information and do no more than pass it on.
7.3 You acknowledge and agree that by using the Websites you are using them at your own risk.

9.1 If any provision of these Terms is found to be void, unlawful or unenforceable for any reason, then that portion of the provision which creates the invalidity, unlawfulness or unenforceability will be severable from these Terms and will not otherwise affect the validity and enforceability of any remaining provisions.
9.2 These Terms will be governed by and construed in accordance with the laws of New South Wales and the Commonwealth of Australia, without giving effect to any principles of conflicts of law. Any legal action or proceeding between JC Property Agents and you related to these Terms will be brought exclusively in a court of competent jurisdiction in New South Wales.
